These Terms of Use (“Terms”) govern your access to and use of the American Recognition Awards website located at arawards.org (the “Site”) and any related services offered by American Recognition Awards (“ARA,” “we,” “our,” or “us”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. About American Recognition Awards

American Recognition Awards is a recognition program that celebrates outstanding achievement among American businesses, entrepreneurs, innovators, and community leaders. ARA evaluates applications submitted through the Site and, at its sole discretion, selects recipients for recognition.

2. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not:

  • Violate any applicable federal, state, or local laws or regulations
  • Infringe upon the intellectual property rights of ARA or any third party
  • Transmit false, misleading, or fraudulent information
  • Attempt to gain unauthorized access to any part of the Site or its systems
  • Interfere with or disrupt the operation of the Site

ARA reserves the right to suspend or terminate access for any user who violates these Terms.

3. Award Applications

By submitting an application through the Site, you represent and warrant that all information provided is accurate, truthful, and complete to the best of your knowledge. Submission of an application does not guarantee selection as an award recipient.

ARA reserves the right to reject, disqualify, or revoke any application or award at any time, including if it is determined that information provided was false or misleading, or that the applicant has engaged in conduct inconsistent with the values of the program.

By submitting an application, you grant ARA a non-exclusive, royalty-free license to use, reproduce, and publish the information and materials you provide (including your name, business name, and description) in connection with the ARA program, including on the Site and in promotional materials.

4. Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is the property of American Recognition Awards or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without express written permission from ARA.

5. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

ARA does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

6. Limitation of Liability

To the fullest extent permitted by law, American Recognition Awards and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Site or the ARA program, even if ARA has been advised of the possibility of such damages.

The Site may contain links to third-party websites. These links are provided for your convenience only. ARA has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

8. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Modifications

ARA reserves the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Pinellas County, Florida.
